Class Actions, or Class Action Lawsuits, are a type of legal action that involves multiple parties and a dispute over an alleged wrongdoing by one party, either regarding a product or a service provided by said party. These lawsuits are filed by a representative of the class, and they can encompass a large collective of affected individuals. Class Actions can arise from an issue or defect found in a product or a service provided that has caused concerns among a large group of similarly effected individuals.

The goal of a class action is to reach a resolution with the entire group of affected class members; retaining positive relations among the affected members, with the hopes that class members will continue to use the party’s products or services in the future.

Ford Edge Vehicle

Vargas, et al. v. Ford Motor Co. DPS6 PowerShift Transmission Class Action Lawsuit

In 2017, Capstone Law APC sought litigation against Ford Motor Company on behalf of a nationwide class of consumers who had purchased or leased 2011 - 2016 Ford Fiestas and 2012 - 2016 Ford Focuses with a dual-clutch or Powershift transmission. The parties reached a settlement agreement that resulted in a Class Action Settlement which was initially approved by the Court in 2017. Following a lengthy appeals process, on March 5, 2020 the District Court approved the revised settlement terms. Currently, the settlement has been amended due to appeals filed against the settlement, and is estimated to go into effect in early April.

DeMars & Associates, Ltd. provides an arbitration component, which is free to the class member, on the back-end of the Class Action Settlement that affords several potential resolutions; repurchase or replacement of the class vehicle, a further repair attempt, or reimbursement for out-of-pocket expenses.

Chrysler Sedan Vehicle

Moran et al. v. FCA US LLC Chrysler Pacifica Class Action Lawsuit

This Settlement resolves litigation against FCA US alleging that certain defects in 2017-2021 Chrysler Pacifica vehicles equipped with a 3.6-liter V6 engine and a 9-speed automatic transmission (“Class Vehicles”) caused the Class Vehicles to suddenly lose power, shut off, or stall without warning.

DeMars & Associates, Ltd. provides an arbitration component, which is free to the class member, on the back-end of the Class Action Settlement that provides Class Members potential resolutions of repurchase or replacement of the class vehicle.
