Program Information
CAP Motors for Motor Vehicle Disputes
The Consumer Arbitration Program for Motor Vehicles is a free service for owners of Porsche vehicles with warranty disputes. Individual Arbitrators review warranty complaints in local areas. Decisions are binding on the manufacturer, once accepted by the consumer.
The principles of dispute resolution incorporate the notions of balance and fairness, and require:
The decision be made by a neutral party
All parties have the same rights and responsibilities
Demonstration of both the fact and appearance of objectivity
Avoidance of any conflicts of interest
Operation within the rules of the program
Decisions on every matter to be expressed in clear and understandable language
CAP-Motors Arbitrator Qualifications & Requirements
The Arbitration Process
DeMars & Associates handles all administrative aspects of the arbitration process, including case intake, screening, scheduling and document collection/ distribution.
Arbitrator is hired as an independent contractor & paid on a per-case basis
FTC §703 guidelines and state regulations require all eligible cases to be processed and resolved within 40 days
Arbitrator is contacted immediately upon receipt of eligible case
Parties may be represented by attorneys at the arbitration and may include the manufacturer and consumer
Arbitrations may take one day
Decision are made after considerations of the applicable State Lemon Law
Arbitrator will render decision within 48 hours
There is an established decision letter template; arbitrator will only need to provide a brief reasoning for decision
Arbitrator Qualification
Candidate be an Attorney or Judge
Practical experience in 10 business/civil arbitrations
Demonstrated ability to remain impartial and comply with all disclosure requirements

CAP-Motors Mediator Qualifications & Requirements
The Mediation Process
DeMars & Associates handles all administrative aspects of the arbitration process, including case intake, screening, scheduling and document collection/ distribution.
Mediator is hired as an independent contractor & paid on a per-case basis
FTC §703 guidelines and state regulations require all eligible cases to be processed and resolved within 40 days
Mediator is contacted immediately upon receipt of eligible case
Parties may be represented by attorneys at the mediation and may include the manufacturer and consumer
Mediations may take one to four hours. Mediators have authority to call impasse when appropriate
Disputes not resolved through mediation will continue on to arbitration
Mediator will draft, collect signatures, and submit mediation agreement to DeMars using mediation agreement template and manufacturer waiver forms
Minimum of 40 hours of mediation training
Mediator Qualifications
